The laws surrounding expungements in Pennsylvania are very clear. If you successfully complete accelerated rehabilitative disposition (ARD), your case will be dismissed and your record expunged. There are certain exceptions that apply to underage sex crimes. Further, if your charges were dismissed, or you were acquitted, you likely have a solid claim for expungement. People 70 years or older are eligible for expungement if they have been free of arrest and prosecution for 10 or more years.
Expunging Juvenile Records And What Is Different
The law takes a more generous view toward young people who commit indiscretions. As a result, juvenile records can be expunged in more situations such as:
- Your complaint or petition resulting from a complaint was dismissed
- It has been six months since your final discharge from supervision under a consent decree and no proceeding is pending
- It has been five years or longer since your final discharge from commitment, placement, probation or any other disposition and referral and since discharge, and you have not been convicted of a felony, misdemeanor or adjudicated delinquent and no proceeding is pending
- You are 18 or older and the court determines expungement is in the best interests of justice
