Delaware County Drug Treatment Court is an option for some people

Substance abuse issues are big problems for some defendants who are facing criminal charges. The Delaware County Treatment Court offers some people who are facing criminal charges to go through an intensive treatment program as part of their sentence for their charges.

The Delaware County Drug Treatment Court is only available to people who don't have a violent criminal history. Certain charges and certain prior convictions, such as crimes against children or weapons charges, can disqualify a person from being able to seek this option.

This program is a voluntary program that is only open to Delaware County residents. In order to be accepted into the program, you have apply. The application process involves signing away some of your rights, such as the right to a speedy trial. If you are accepted into the program, you will be monitored and supervised throughout the process by the Office of Adult Probation and Parole. You will also be under the supervision of the Treatment Court judge.

The program lasts 30 months at a minimum. In order to successfully complete the program, you must work through a series of levels that each have specific requirements. Some participants in this program will have their charges dropped and expunged when they complete the program.

If you fail to comply with the program, the judge can order a variety of sanctions, including up to 10 days in jail. You can also face house arrest or community service if you don't comply with the program.

People who are unsuccessful in completing the program will be sent back to court on their original charges. That can lead to incarceration and other penalties.
