Pennsylvania needs to see an end to mandatory minimum sentencing

The prison population is high in Pennsylvania, as it is throughout the country. This is partially due to the lengthy sentences that individuals are given for non-violent crimes. In order to reduce the prison population and stop rising incarceration costs, Pennsylvania legislators are seeking to remove mandatory minimum sentencing for certain crimes.

Many people in Pennsylvania view the mandatory minimum sentences as unconstitutional, harmful and even ineffective. With mandatory minimum sentences in place, those convicted of similar offenses are all treated alike. This means that their sentences are the same regardless of the important differences in their cases.

Should the mandatory minimums be eliminated, judges will have more discretion and will be able to sentence offenders based on their individual cases. For example, many people convicted of drug possession would benefit more from attending drug treatment and rehabilitation programs than they would from serving time behind bars. In fact, some judges in Pennsylvania have already decided to take matters into their own hands by refusing to impose mandatory minimum sentences based on their personal views and academic research.

Mandatory minimum sentencing is viewed by many as unjust, and many Pennsylvania residents are urging the state's lawmakers to take action to end mandatory minimum sentences. Until that happens, it is crucial for those charged with crimes in Pennsylvania to ensure that their rights are protected during criminal proceedings. A criminal defense attorney who is familiar with the state's criminal court system may prove to be an accused individual's most valuable ally.
